A window manufacturer has been penalised by the court after its negligence caused an employee to lose a finger and severely injure another. The case also brought to light some failings by the company in insuring the employees.
The accident occurred last May when Jeremy Adams was cutting window frames on a double pivoting head mitre cutting saw at M&M Windows Ltd’s factory in Quarry Bank, Brierley Hill. The saw blade sliced off Adams‘ left index finger while his middle finger received injuries serious enough to require surgery and reconstruction. He has not been able to work ever since the accident.
Investigation into the cause of the accident not only reflected the company’s irresponsibility in maintaining proper health and safety procedures but also found that agency workers employed by the company had not been given any accidental insurance cover.
During the hearing of the case M&M Windows Ltd accepted liability for breaching Section 2(1) of the Health and Safety at Work Act 1974 and Section 1(1) of the Employers’ Liability (Compulsory Insurance) Act 1969. Consequently, Dudley Magistrates ordered the company to pay £10,000 as fine and additional costs of £2,500.
HSE inspector Jenny Skeldon said Adams was a victim of the company’s irresponsible attitude. She said the employers should have introduced standard safety measures at the workplace and guarded the sharp blade to protect their workers, which they failed to do. Skeldon said that it was very evident that the blade was a high risk component of the machinery.
Skeldon was extremely critical of M&M Windows for failing to insure its agency workers against injuries. She urged employers to see that all their workers, whether they were permanent employees or agency staff, were insured for any injuries received at the workplace.

Following the accident, the company was charged with violations of the health and safety rules. It pleaded guilty and it was awarded a fine of £65,000 and costs of £27,500, as proceedings concluded at Gloucester Crown Court. The presiding judge said that proper safety measures had not been implemented by the farm.
In defence of the company, spokesperson Adrian Darbishire said that the company has high standards for all operations, but the health and safety measures have fallen below these standards.
